Funding a Claim

Clinical Negligence claims can be expensive to pursue and it is therefore important to consider how a claim is to be funded from the outset.

1. Legal Expense Insurance

It is important that enquiries are made to see whether funding is available through insurance policies, the sort which we all have to insure our home and belongings.  These policies often include cover for legal expenses.
 
Other types of insurance which can fund legal claims are those related to credit cards and occasionally, motor insurance.
 
These policies of insurance have very strict time limits in which a person has to claim.  Usually, although not always, the time limit is 180 days from the date of the alleged negligence.
 
It is therefore extremely important to investigate the availability of such policies as a means of funding a clinical negligence claim at the outset.
 
The complaints procedure can still be pursued after an insurance company have agreed to insure the claim.  Legal action will of course not start until after the complaints procedure has been exhausted, it just means that the insurance company is aware of the claim and if necessary will fund the necessary investigations to pursue a potential clinical negligence claim.
 
Sometimes support for legal costs can also be available through membership of a Union or another association.

2. Public Funding - Legal Aid

Langleys have a franchise from the Legal Services Commission to conduct Clinical Negligence claims.  Applications for public funding can be made where individuals are financially eligible.  The Legal Services Commission will grant a limited public funding certificate if they are satisfied that there are reasonable grounds to pursue a claim and that the value of the claim is such that it warrants the cost of taking legal action.

3. Conditional Fee Agreement

Langleys can consider entering into a Conditional Fee Agreement, otherwise known as a 'No Win No Fee' Agreement, once an assessment of the claim has been made.
