Legal Update: Ilott v Mitson and Others [2011] EWCA Civ 346

The Court of Appeal recently ruled in favour of estranged adult daughter who was excluded from her late mother’s Will which left her whole estate to charity. The claim was made by the daughter under the Inheritance (Provisions for Family and Dependants) Act 1975. Family members could find it much easier to bring a claim following this ruling where the judge found it ‘unreasonable’ for her to have placed such charities before her own daughter.
